Terms of Use

Welcome to Firstdraft.fit. These Terms keep things fair for you and for us. Please read them: they're short and in plain English.
1. Who we are
Firstdraft.fit is operated by Georgia Moses, trading as Firstdraft.fit, a sole trader based in New Zealand ("we", "us"). You can contact us at hello@firstdraft.fit.
These Terms of Use ("Terms") govern your access to and use of the Firstdraft.fit website and tools (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
2. The Service
Firstdraft.fit provides tools for sewists and fashion designers, including custom pattern-block generation from your body measurements, a project workspace, a mood board for reference images, and fabric and construction guidance.
The Service is currently in beta. Features may change, be withdrawn, or behave imperfectly. We will do our best to give notice of significant changes, but we do not guarantee uninterrupted availability.
3. Your account
You must provide accurate information when registering and keep your login credentials secure. You are responsible for activity that happens under your account.
You must be at least 16 years old to create an account.
You may delete your account at any time. We may suspend or close accounts that break these Terms, after giving notice where reasonably possible.
4. Your content
You keep ownership of everything you upload or create on the Service: your measurements, reference images, projects, and notes ("Your Content").
You grant us a limited licence to store, process and display Your Content solely to provide the Service to you. If you explicitly choose to share a reference image with the community (an opt-in setting), you also grant us a licence to display it to other users until you unshare or delete it.
- Only upload images you own or have the right to use.
- Do not upload unlawful, infringing, or offensive material.
- We may remove content that breaks these rules.
5. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose.
- Attempt to access other users’ data or interfere with the operation of the Service.
- Scrape, copy, or resell the Service or its content without our written permission.
- Upload malicious code or attempt to circumvent security or rate limits.
6. Patterns and fit (important)
Pattern blocks generated by the Service are drafting starting points ("first drafts"), not finished, guaranteed-fit patterns. Fit depends on accurate measurements, fabric choice, and construction. Always make a toile (test garment) before cutting into your final fabric.
We are not liable for fabric, materials, or time spent on garments made from generated blocks.
7. Intellectual property
The Service, including its software, design, drafting logic, and written guidance, belongs to us or our licensors. Blocks generated from your measurements are yours to use for personal and commercial sewing; you may not resell the generated pattern files themselves as templates or a competing service.
8. Consumer law and liability
Nothing in these Terms limits rights you have under New Zealand law that cannot be excluded, including your rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 where they apply.
Otherwise, the Service is provided "as is" during beta. To the extent permitted by law, we are not liable for indirect or consequential losses, loss of data caused by events outside our reasonable control, or losses arising from use of the Service contrary to these Terms or our guidance. Our total liability to you is limited to NZ$100 or the amount you have paid us in the last 12 months, whichever is greater.
9. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or an in-app notice before they take effect. Continuing to use the Service after changes take effect means you accept the updated Terms.
10. Governing law
These Terms are governed by the laws of New Zealand, and the New Zealand courts have exclusive jurisdiction over any dispute arising from them or the Service.
